CCA Seminars – Introduction to New and Clarified CCDC Construction Documents

The Canadian Construction Documents Committee (CCDC) has developed four new documents, which will be released in May 2016. During this seminar, CCDC members will explain to you the key philosophy behind these new documents and instructions on their correct use:

CCDC 2M – Master Agreement and Work Authorization
CCDC 2M is developed to meet the needs of Owners with an on-going construction or maintenance program: to enter into specific work arrangements quickly and easily, without having to review and re-negotiate general terms and conditions for each work order.

The Master Agreement is a contract form between Owner and Contractor that is applicable for a defined period of time and is intended to establish contractual terms and conditions (excluding scope, time and cost) for multiple projects during that time period. Each project will be ordered by means of Work Authorizations, that define the project specific requirements like scope, price, time.

CCDC 3 – Cost-Plus Contract (update)
CCDC 3 is a contract form between Owner and Contractor to perform the required work on an actual-cost basis, plus a percentage or fixed fee. There will be a detailed analysis of when an Owner should consider using CCDC 3, the pros and cons of the cost-plus contracts, and the roles and risk profiles of the Owner and Contractor. Other key topics include the calculation of fee, GMP option, review and approval of expenses, subcontracting, correction of defects, etc.

CCDC 29 – Guide to Pre-Qualification
CCDC 29 is developed for Procurement Authority (e.g. Owners, Consultants, Construction Managers, Design-Builders) to explain and recommend best practices through the entire pre-qualification process. There will be discussions on how to determine whether pre-qualification is necessary and appropriate during the procurement planning, comparison of various types of pre-qualifications (unlimited, short-listing, source-list), best practices for Request for Qualifications (checklist, submissions, evaluation and interviews, notification and debriefing). There will also be an explanation of the revised CCDC 11 ‘Contractor’s Qualification Statement’ and its correct use.

CCDC 24 – A Guide to Administrative Support Documents (update)
CCDC 24 is a guide document to assist users of CCDC 2 - 1994 in meeting the administrative requirements outlined in that standard contract form. For each model form the guide contains a brief explanation of each of the administrative processes involved, a short narrative description to guide users of the form, a list of items which should be included in the form, and an example of a model form.

The CCDC members will also provide an update and seek your input on the priority documents that the Committee is working on.

The Canadian Construction Documents Committee (CCDC) has prepared a new edition of CCDC 21 ‘A Guide to Construction Insurance’, which will be released in May 2016. During this seminar, members of the CCDC Insurance Sub-Committee will explain to you the insurance requirements in standard CCDC contract forms and provide an overview of CCDC 21.

The authors of CCDC insurance provisions will explain in simple terms the insurance requirements in CCDC contract forms, the types of policies necessary to comply with such requirements, when there may be a need to require broader or different coverage to the minimum standard insurance provisions specified in CCDC contract forms.

They will also provide an overview of CCDC 21 that covers all important issues relating to construction insurance:

  • General Liability Insurance – Coverage offered by standard policy IBC 2100 and CCDC Endorsement IBC 2320, who is insured and the coverage for Additional Insured, exclusions, Umbrella Liability insurance, six-year coverage for completed operations etc.
  • Builder’s Risk Board Form Property Insurance – Insured and excluded property, major excluded perils, suggested additional coverages (e.g. soft costs, delayed start-up, expediting expense, early occupancy, testing and commissioning, valuable papers, electronic data and cyber threats), renovation projects, negotiating coverage etc.
  • Other Insurance – Important considerations for Boiler and Machinery (Equipment Breakdown) Insurance, Automobile Liability Policy Insurance, Aircraft and Watercraft Liability Insurance, Contractors’ Equipment Insurance, Professional Liability Insurance, Wrap up Liability (with Wrap Up Difference in Condition Endorsement and coverage for completed operations), Installation Insurance.
  • Practical Tips on Critical Insurance Issues – Selection of insurance representatives, claims process (reporting, handling, proof of loss), subrogation etc.

The Canadian Construction Documents Committee (CCDC) is a national committee responsible for the development, production and review of standard Canadian construction contracts, forms and guides. Formed in 1974, the CCDC is made up of volunteer owner representatives from public and private sectors, as well as appointed volunteer members of the four constituent organizations (ACEC, CCA, CSC and RAIC).
